The classical trinity action in passing off is Goodwill-Misrepresentation-Damage. The can drink has checkered logo, “F1 Racing” words and two website addresses that belong to Formula One group. Formula One said consumers will be misled into thinking that the drinks are connected to or endorsed by it. The logo is similar to its F1 trademark and consumers who visit the websites provided on the cans are redirected to the official Formula One website. In other words, there will be confusion and the onus is for Formula One to prove likelihood of confusion.

In defence, the can drink distributor – Speed Drinks argued that “F1″ was a generic term. Formula One rejected the suggestion that “F1″ was generic since the trademark has been registered in Singapore.

Latest update from BusinessWeek, Formula One settled its dispute with Speed Drinks after the beverage distributor agreed to stop selling its F1 Racing Energy Drink in Singapore, host of the first night race of the world’s most-watched motor sport.

Formula One Licensing BV agreed to withdraw its lawsuit against Speed Drinks if the distributor retracts its challenge stating that the ‘F1’ trademark was indistinctive or generic, according to court papers filed after a closed door Singapore High Court hearing yesterday.

Speed Drinks, which acknowledged that Formula One is the owner of the “F1” trademarks in Singapore, must also hand over 65,000 cans of the beverage to be destroyed and end its contract with their Dutch supplier. No payment to Formula One is required. Please recycle them.

In this rally which some called it Bear Rally. Not many investors can predict this as a near Two bagger when Singapore is in recession. But it will be a good source of income for unemployed like me if a year of source of income was used to buy UOBKH. As my friends strongly advised me not to quit without a job because there will be a loss in opportunity cost and we should stay relevant for the job market. A friend asked me how I kill time. I replied that I “shake leg @ home”. In fact, I spent lots of time reading, jogging and asking myself what do I want in my life. My friend’s reply shows that he does not know what to do when he is free. I believe that stress is self-inflicted because we look for higher pay with greater responsibilities as we gain work experience.

I like more of UOBKH because it is cheap and predictable. It provides consistent dividend payout. It had many good track records as a Seven bagger (1992 ~ 1993) after the Gulf War and a Four bagger (2002 ~ 2007)

I shall sell other stocks on hand and accumulate cash, wait and Buy UOBKH @ $0.80 (probably in Sep/Oct 2009). If there were another Bear Rally to occur later then I can sell and double my money. Otherwise, I can dollar cost average my portfolio of UOBKH. Focus all my cash and Buy UOBKH @ $0.40 (perhaps in Mar 2010). According to Businessweek, “throughout history, bear markets have varied widely in length and severity. If March 2009 turns out to have constituted the low, this bear market will have lasted 17 months. By contrast, the stock market fell every year from 1929 to 1932. The last bear market—from 2001 to 2003—lasted 30 months“. In other words, we have another 11 months to go before the Bull return.
